Agreement to Terms
By accessing or using KairoView ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access the Service.
Description of Service
KairoView is a trading journal application that allows users to track, analyze, and review their trading activities. The Service includes features such as trade logging, performance analytics, portfolio management, and data import capabilities.
User Accounts
To use KairoView, you must create an account using email/password or Google Sign-In. You are responsible for:
- Maintaining the security of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized use of your account
Age Requirement
You must be at least 18 years old to use this Service.
During registration, you are required to provide your date of birth. We use this information solely to verify that you meet the minimum age requirement. By providing your date of birth and creating an account, you confirm that:
- You are at least 18 years of age
- The date of birth you provide is accurate and truthful
- You have the legal capacity to enter into a binding agreement
If we discover that a user is under 18 years of age, we will immediately terminate their account and delete all associated data.
Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the rights of others
- Transmit harmful code, viruses, or malicious software
- Attempt to gain unauthorized access to the Service or its systems
- Interfere with or disrupt the Service or servers
- Collect or harvest user data without authorization
- Use the Service for any fraudulent or illegal purpose
User Content
You retain ownership of all trading data, notes, and other content you submit to the Service ("User Content"). By using the Service, you grant us a limited license to store, process, and display your User Content solely for the purpose of providing the Service to you.
You are solely responsible for the accuracy and legality of your User Content. We do not verify or endorse any trading information you submit.
Financial Disclaimer
KairoView is strictly a data recording and analysis tool. We do not provide:
- Investment advice or recommendations
- Financial planning services
- Trading signals or strategies
- Trade execution or brokerage services
Data Accuracy: You acknowledge that all calculations (e.g., PnL, Win Rate) are entirely dependent on the data you input. We do not guarantee the accuracy of any external market data and are not liable for discrepancies between our display and your actual brokerage account statement. Your brokerage statement is the only authoritative source of your financial standing.
Trading involves substantial risk of loss and is not suitable for all investors. Past performance is not indicative of future results. Consult with a qualified financial advisor before making any investment decisions.
Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by KairoView and are protected by international copyright, trademark, and other intellectual property laws.
Service Availability
We strive to maintain high availability of the Service, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
We reserve the right to modify, suspend, or discontinue any part of the Service at any time with or without notice.
Limitation of Liability
To the maximum extent permitted by applicable law, KairoView shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation:
- Loss of profits, data, use, goodwill, or other intangible losses
- Your access to or use of or inability to access or use the Service
- Any conduct or content of any third party on the Service
- Unauthorized access, use, or alteration of your transmissions or content
- Trading losses or investment decisions made based on Service data
In no event shall our total liability exceed the amount you have paid us in the past six (6) months, or €50.00, whichever is greater.
Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be error-free, secure, or uninterrupted, or that any defects will be corrected.
Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including breach of these Terms. Upon termination, your right to use the Service will cease immediately.
You may delete your account at any time by contacting us. Upon account deletion, we will remove your User Content in accordance with our Privacy Policy.
Changes to Terms
We reserve the right to modify these Terms at any time. We will notify users of any material changes by updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the modified Terms.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to conflict of law provisions.
Any disputes arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Estonia. For EU consumers, this does not affect your statutory rights under consumer protection laws in your country of residence.
